Shipping and Returns policy

LEGAL NOTICE: These Policies are an integral part of, and are governed by, our master Terms & Conditions. By completing a purchase on this site, the Buyer acknowledges that they have read, understood, and provided express legal consent to both this document and our full Terms of Service.

I. ORDER PROCESSING & LOGISTICS

  1. Fulfillment Hours: Our logistics department operates Monday through Friday, 9:00 AM – 4:00 PM EST, excluding National and State holidays.

  2. Processing Timeline: All orders are subject to a mandatory processing period of 1–5 business days prior to dispatch. Processing time is independent of the transit time provided by the carrier.

  3. Carrier Selection: Shipments are facilitated via UPS, DHL, or USPS. Peligro Sports reserves the right to select the most efficient carrier based on destination, weight, and service reliability.

  4. Address Accuracy: The Buyer is solely responsible for providing a complete and valid shipping address. Peligro Sports is not liable for delivery failures resulting from insufficient address information (e.g., missing building numbers, suite identifiers, or incorrect zip codes).

II. DOMESTIC & INTERNATIONAL SHIPPING TERMS

  1. Non-Refundable Fees: All shipping and handling fees are considered final and non-refundable once the carrier has taken possession of the parcel.

  2. International Duties & Taxes (DDP): For international orders handled via DHL or UPS, applicable duties and taxes are calculated and collected at checkout. Peligro Sports utilizes "Delivered Duty Paid" (DDP) protocols to ensure a streamlined customs experience.

  3. Customs Compliance: The Buyer acts as the Importer of Record. Any refusal to accept a package due to local customs regulations or additional local fees will result in the forfeiture of the original shipping cost, and any return-to-sender fees will be deducted from the final refund.

III. DELIVERY DISPUTES & CARRIER INVESTIGATIONS

  1. Transfer of Liability: Responsibility for the merchandise is considered transferred to the Buyer once the carrier’s tracking system confirms a ‘Delivered’ status.”

  2. Reporting Window: Any claims regarding misdelivery, theft (porch piracy), or transit damage must be formally reported to Peligro Sports within three (3) calendar days of the marked delivery date.

  3. Investigation Protocol: Peligro Sports will initiate a formal investigation with the carrier. Refunds or replacements will only be issued upon the successful conclusion of the carrier’s claim process.

IV. RETURN & EXCHANGE PROTOCOLS

  1. Eligibility Period: Return requests must be initiated within 30 days of the delivery date. Requests exceeding this window will be systematically declined.

  2. Product Condition Standards: To qualify for a refund, items must be returned in Original Condition:

    • Unused, unwashed, and free of odors (tobacco, perfume, etc.).

    • All original tags, stickers, and protective packaging must be intact.

    • Footwear must be returned in the original manufacturer’s box, which must be placed inside a separate shipping carton. Affixing tape or labels directly to the product box voids the return eligibility.

  3. Customized Merchandise: Products featuring custom names, numbers, or designs are Final Sale. No returns or exchanges are permitted unless a manufacturing defect or clerical error by Peligro Sports is proven.

V. REFUNDS & FINANCIAL DEDUCTIONS

  1. Mandatory Inspection: All returns undergo a quality control inspection. Peligro Sports reserves the right to issue a partial refund or deny the return if the item does not meet the standards outlined in Section IV.

  2. Return Shipping Costs: The Buyer is responsible for all return logistics costs.

  3. Prepaid Label Deductions: If Peligro Sports provides a prepaid return shipping label for the Buyer's convenience, the actual cost of the label (e.g., $8.87 USD or higher depending on weight) will be strictly deducted from the final refund amount.

  4. Restocking Fee (Multi-Size Returns)

    Returns involving the purchase of multiple sizes of the same item for fitting purposes may be subject to a restocking fee. This fee is applied to cover handling, processing, and inventory management costs associated with non-standard return patterns.

  5. Processing Time: Approved refunds are processed within 5–10 business days. Please note that individual bank processing times are beyond the control of Peligro Sports.

VI. LIMITATIONS, SECURITY & DISPUTES

  1. Freight Forwarding: Peligro Sports reserves the right to cancel orders destined for freight forwarders or unverified forwarding services.

  2. Policy Enforcement: We reserve the right to decline service to any account demonstrating a pattern of "friendly fraud" disputes.

  3. Legal Dispute Resolution: All transactions and potential disputes are strictly subject to the Dispute Resolution and Chargeback clauses outlined in Section 10 of our Terms & Conditions. By finalizing this order, the Buyer agrees to contact Peligro Sports NYC to resolve issues before initiating a formal bank dispute.
